“Show Us The Real ‘U’ in Uniform” Contest

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The “Show Us The Real ‘U’ in Uniform” Contest (the “Contest”) begins at 12:01 PM Eastern Time (“ET”) on May 3, 2010, and ends at 11:59 PM ET on September 15, 2010 (the “Promotion Period”).

ELIGIBILITY: To participate in this Contest, you must be a legal resident of the 50 United States or the District of Columbia and be at least 13 years of age at time of entry. Entrants must either attend or be the parent/legal guardian of a child who attends a school that requires its students to wear uniforms as part of its dress code. Employees of LT Apparel, its affiliates, parent company, subsidiaries, advertising and promotion agencies, vendors, and any individual or company directly associated with this Contest, and the immediate families of these employees (parents, children, siblings, spouse) as well as members of the respective households of these employees (whether related or not) are not eligible to participate. Void outside the 50 United States and D.C. and where prohibited.

HOW TO ENTER: To enter the Contest, visit www.uinuniform.com (the “Website”), follow the links to the Contest entry page, and complete the following steps: 1) Complete the Contest entry form in its entirety; 2) Provide an essay of up to 300 words explaining how you are/your child is unique in your/his or her school uniform; 3) Provide the required information about your/your child’s school and uniform preference; 4) Select whether you would like to provide a video or photos with your entry, and follow the instructions to provide either a video, along with a photo of you/your child in your/their school uniform, or up to six (6) photos of you/your child, showing how you are/your child is unique in your/his or her school uniform; and 5) Check the box to agree to and accept the Official Rules and click Submit (collectively, the “Entry”). Videos must not exceed 2 minutes in length, and must feature you/your child in your/his or her school uniform. Limit: One (1) Entry per person during the Promotion Period.

In the event of a dispute as to the identity of an entrant, any disputed entry will be deemed made by the “authorized account holder” of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries made by any other individual or entity that is not the person named on the submitted entry, or made in any manner inconsistent with these Official Rules, will be declared invalid and disqualified from this Contest.

CONTEST ENTRY CRITERIA: Each Entry must meet the following content restrictions:

  • The Entry must not contain material that violates or infringes on another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement;
  • The Entry must not contain brand names or trademarks;
  • The Entry must not contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous or libelous;
  • The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • The Entry must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Entry is created.

By submitting an Entry, you warrant and represent that: (a) it is your original work and has been legally created; (b) it has not been previously published or distributed in any media or public forum; (c) it has not been entered into or won previous contests or awards; (d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (e) that you have obtained written permission from any person whose name or likeness is used in the Entry (the “Participant”). If a Participant is a minor, written permission must be granted by the Participant’s parent/legal guardian. Participants, or the parent/legal guardian of Participant, must transfer all rights for usage to the Sponsor if and as requested; (f) you own all rights to your Entry, including without limitation, copyrights, and, that you have received prior written permission from the videographer/photographer if any video/picture was videotaped/photographed by someone other than the entrant him/herself; (g) publication of the Entry via various media including Web posting, will not infringe on any third party rights; and (h) you will indemnify and hold harmless the Sponsor and related entities or agents from any claims and damages (including reasonable attorneys' fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, your Entry, or your conduct in creating your Entry or otherwise in connection with this Contest. Sponsor reserves the right to edit, remove, reject or disqualify (along with the entrants who submitted them) any Entry which, in its opinion or the opinion of the judges, violate any of these Official Rules or are otherwise inappropriate.

PRIZES: Grand Prize: There is one (1) Grand Prize available to be won. The Grand Prize includes $10,000 to be awarded to the entrant, and $5,000 in French Toast school uniform vouchers will be awarded to the school the entrant attends (or the school of the child featured in the entry if submitted by the parent/legal guardian of the featured child), to be used exclusively at the retailer where they purchase their school uniforms. School uniform vouchers will be distributed at the sole discretion of the designated school. The Approximate Retail Value (the “ARV”) of the Grand Prize is $15,000.

First Prize: There are five (5) First Prizes available to be won. Each First Prize includes $500 to be awarded to the entrant, and $100 in French Toast school uniform vouchers to be awarded to the school the entrant attends, (or the school of the child featured in the entry if submitted by the parent/legal guardian of the featured child), to be used exclusively at the retailer where they purchase their school uniforms. School uniform vouchers will be distributed at the sole discretion of the designated school. The ARV of the First Prize is $600 each.

Second Prize: There are four (4) Second Prizes available to be won. Each Second Prize includes a $100 gift card. The ARV of the Second Prize is $100 each.

The total ARV of all prizes available to be won: $18,500.

CONTEST JUDGING AND NOTIFICATION: Entries will be judged in two rounds of judging.

First Round of judging

The First Round of judging will be conducted by a panel of judges, to be determined by the Sponsor, based on the following criteria to determine the ten (10) top-scoring entries (the “Finalists”). Finalists will be determined on or around November 1, 2010.

  • Originality (30%)
  • Creativity (30%)
  • Authenticity (30%)
  • Quality of photos/video (10%)

Second Round of judging

The ten (10) Finalist entries will be posted at www.uinuniform.com upon completion of the First Round of judging where individuals may vote for their favorite entry. All votes in the Second Round of judging must be cast by 11:59 PM ET November 21, 2010. Limit: One (1) vote per person.

The Finalist entry that receives the most votes in the Second Round of judging will be named the potential Grand Prize winner. The Finalist entries that receive the second to sixth most votes in the Second Round of judging will be named the potential First Prize winners. The remaining Finalist entries will be named the potential Second Prize winners.

In the event of a tie in any round of judging, the tied Entry with the highest score in the “Creativity” criteria in the First Round of judging will be deemed the winner. Winners will be notified by telephone and/or confirmed in writing via US mail or other form of home delivery within five (5) days of the close of the Second Round of judging. If a minor wins a prize, the prize will be awarded to the winner's parent or legal guardian in the name of the winner. Winners, or the winner’s parent or legal guardian if the potential winner is a minor, will be required to sign an Affidavit of Eligibility, Liability Release, and, where allowable, a Publicity Release to be returned within seven (7) days of initial notification, or prize award will be void and the next highest scoring entrant notified. Grand Prize winner, or the Grand Prize winner’s parent or legal guardian if the selected winner is a minor, will also be required to provide his/her Social Security Number for tax reporting purposes.

If Sponsor so elects, Finalists may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify a potential prizewinner on the basis of the findings resulting from such background check.

PRIZE CONDITIONS: Winners’ Entry and acceptance of a prize awarded constitutes permission for the Sponsor to use said winner’s Entry, name, image, photograph, likeness, statements, biographical information, voice and address (city and state) commercially or non-commercially, in all forms of media known or unknown, in perpetuity, worldwide, without notice or further compensation, except where prohibited.

PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESSED OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

TERMS AND CONDITIONS: No transfer, substitution or cash value equivalent for any prize is available, except at sole discretion of Sponsor. This Contest is subject to all applicable federal, state, and local laws. All federal, state, or other tax liabilities, if applicable, are the sole responsibility of the prizewinner. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, judges and Independent Contest Administrator, and waive any right to claim ambiguity in regard to the Contest mechanics, and/or the interpretation of these Official Rules. All entrants, and any selected winner, agree to release, discharge, indemnify and hold harmless the Sponsor, any vendors/prize providers that may be associated with this promotion, and the respective officers and employees of these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person or property of any kind resulting in whole or in any part, directly or indirectly, from participation in this promotion, or for any prizes won.

All Entries and all rights of ownership and publication of the Entry will become the property of Sponsor and will not be returned. By submitting an Entry, entrants and all Participants agree that Sponsor has the unrestricted right to use any Entry in whole or in part, commercially or non-commercially, in all forms of media known or unknown, in perpetuity, worldwide, including the right to publish and display the Entry for advertising and publicity, and to edit and make derivative works, without notice or compensation, except where prohibited. Entrants also agree that Sponsor may post any Entry, including the entrant’s first name, on its Web site(s) and/or its Web pages on third-party sites.

LIMITATIONS OF LIABILITY: Incomplete, corrupted or untimely Entries, or any Entry generated by a script, macro or other automated means are void and will be disqualified. Sponsor and its agencies are not responsible for incomplete, corrupted or untimely Entries or for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. The Website's database clock will be the official timekeeper for this Contest. Sponsor, its affiliate companies, parents, subsidiaries, officers, directors, and agents are not responsible for any incorrect or inaccurate information, including, without limitation, that caused by Web site users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor may, in its sole discretion, void any suspect Entries and (a) cancel, modify or terminate the Contest (or any portion thereof); (b) modify the Contest or suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (c) award the prizes from among the eligible, non-suspect Entries received up to the time of the impairment. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
